Hutton SA pays remarkable attention to monitoring legal and operational risks. We operate leading international banking institutions, and through the administrative power of attorney issued by the client to the management company, under a specific mandate, we develop our operations, thus maintaining the separation of assets.
Our code of ethics, was introduced to limit individual operational skills, define rigorous criteria for internal control of operations, improve access to data and confidential information and optimize the work of the relationship with the client.
Swiss regulation operates for the purposes of investor protection, such as:
– Swiss supervisory body for asset managers and trustees (AOOS)
– Auditing firm
The Financial Institutions Act (LIsFI) entered into force on 1 January 2020. With the law's entry into force, asset managers and trustees must apply for authorization from FINMA, the Swiss Financial Market Supervisory Authority, and are subject to supervision by an authorized supervisory body (OV). This ongoing supervision oversees the activity of asset managers and trustees affiliated with it regarding compliance with the provisions of the law and authorization requirements. The OV is, in turn, authorized and supervised by FINMA.
AOOS - Swiss oversight organization for asset managers and trustees was founded with the aim to manage an OV according to the LIsFI as a specific service for asset managers and trustees. The company also aims to operate a self-regulatory organization under the Money Laundering Act (AMLA). To achieve this mission with the highest quality required, specific industry knowledge is required. Employees with many years of experience in the supervision of asset managers and trustees and proven supervisory methods and technologies ensure this.
The AOOS has the principle of keeping supervisory procedures efficient and straightforward. At the same time, effective supervision must be ensured in the interest of all financial service providers and their clients. AOOS is at the service of the Swiss financial center and investors, who benefit from a competent and functional OV. AOOS acts independently. AOOS thus becomes the cornerstone of asset managers and trustees in implementing the LSerFI, LIsFI, and LRD requirements.
Hutton SA makes use, for what concerns the audit, of an auditing firm recognized by the Federal Authority (SOLEFID SA, Viganello); the auditing firm also carries out annual audits of the SRO, reporting the results to the ASG.
